Aggravated assault trial will go ahead for accused in case of violent attack on homeless man who later died
Kevin Procure faces four trials, the most serious of which left victim Dwight Nelson with cracked skull in incident allegedly caught on CCTV

Lawyers for Crown counsel and defence were in provincial court in Chilliwack on Wednesday (Nov. 4, 2026) for what was hoped to be a resolution in the case of Kevin Procure who is charged with aggravated assault of a man who later died.
There was, however, no resolution as Procure’s lawyer Chris Terepocki told the court his client has “chosen a slightly different path.”
Procure is facing four separate trials in the coming months, the most serious of which is for one count of aggravated assault for an alleged incident on Feb. 21, 2026. In that case, Procure is alleged to have hit 37-year-old Dwight Nelson in the head with a two-by-four near downtown Chilliwack cracking his skull.
The incident and movements leading up to the alleged crime were caught on various CCTV feeds from businesses in the Railway Avenue area near Young Road. The quality and how much was captured on those cameras is likely to be in question at trial.

Before that alleged aggravated assault, the 40-year-old Procure is charged with assault for an allegation on Nov. 26, 2025. Out of custody after that, he is charged with a breach from an allegation on Feb. 13, 2026. He was released again on Feb. 14, and he faces a second breach charge from Feb. 27.
In between those dates, on Feb. 21, is when Procure is alleged to have struck Nelson with the piece of wood causing serious injuries. Nelson actually died on March 5, but unusual circumstances meant Procure was not charged with a more serious offence such as manslaughter or murder.
After the alleged assault, Nelson went to Chilliwack General Hospital but he left due to long waits and did not see a doctor. Two days later, bleeding from his ears, he went back to the hospital and a CT scan revealed a skull fracture and bleeding on the brain. Nelson declined being admitted to hospital leaving only with ibuprofen.
Ten days later, he hit his head on a homemade chandelier in a make-shift structure he was living in with his girlfriend in the woods. His girlfriend got him brought back to the hospital. He was medevaced to Royal Columbian Hospital where he was pronounced dead. Because of the second head injury in between the alleged aggravated assault and his death, Procure was not charged in the death.
At a bail hearing on April 14, 2026, Crown counsel Michelle Wray told Judge Michael Fortino they were not alleging a homicide because the hitting of his head on the chandelier broke the chain of events from the Feb. 21 violent attack to Nelson's death on March 5.
Procure was denied bail that day in April and has been in custody since then. He appeared in court on Wednesday (Nov. 4, 2026) wearing the standard orange sweats issued to inmates in pretrial custody. He has a full beard and long dirty blond hair.
Procure faces four trials in the coming months, starting with a trial on Nov. 12 on the second breach charge. No trial date is set yet for the first breach. He then faces trial on Feb. 8 for the original assault predating all the other charges. On the substantive aggravated assault charge, his 12-day trial scheduled to run Feb. 22, 23, 24, 25, and March 1, 2, 3, 4, 8, 9, 10 and 11.
